Terms of Use

This is an English translation of the Japanese Terms of Use. If there is any difference between the two, the Japanese version prevails.

1.Introduction

These Terms of Use (the “Terms”) set out the conditions for using the iPhone app “Niairo” (the “App”). They apply between the developer of the App (the “Developer”) and you. By downloading, installing or using the App, you agree to these Terms.

2.The service

The App's main features are:

A self-check of your body type (Straight, Wave, Natural) and personal color (four seasons) (the “Diagnosis”), and saving and sharing a result card
A “Detailed Report” that explains your Diagnosis result in detail (the “Report”)
A feature where AI reads features such as fabric and color (“Attributes”) from an image of clothing you choose, and shows a guide for your type as ◎, ○ or △ (a “Check”)
A notebook to look back on your type's key points and past Checks

The Diagnosis, Report and Checks are guides for choosing clothes and makeup, derived from your answers or images by set rules. They do not guarantee the same result as an in-person consultation with a professional, that anything will suit you, or that you will be satisfied with what you buy.

For Checks, AI reads Attributes from images. Depending on how an item appears, Attributes may be read incorrectly, or a Check may not be possible.

Purchases of products are your own decision and responsibility. The Developer has no relationship with the products checked in the App or their sellers.

3.Free and paid features

The App is free to download, and the Diagnosis and result card are free. The Developer will not make them paid later
Your first 3 Checks are free (the sample Check during onboarding does not count toward them)
Additional features are offered as the paid “Detailed Report” and “Niairo Plus” (together, “Paid Features”). Their contents and prices are shown on the purchase screen in the App

3.1 Paid Features

Detailed Report: a one-time purchase (¥1,480 on the Japanese App Store)
Niairo Plus: an auto-renewable subscription (¥680 per month or ¥4,800 per year on the Japanese App Store). It includes up to 10 Checks per day, the Report and unlimited Check history

3.2 Purchase and payment

Paid Features can be bought through in-app purchase on Apple's App Store. Payment is charged to your Apple Account when you confirm the purchase
The price is the amount shown on the purchase screen
Niairo Plus renews automatically for the same period, and the renewal is charged, unless cancelled at least 24 hours before the end of the current period
You can manage or cancel it in your App Store account settings (your Apple Account in the iPhone Settings app). Deleting the App does not cancel the subscription
Refunds follow Apple's methods and conditions. The Developer cannot process refunds
Purchased Paid Features can be restored with “Restore Purchases” using the same Apple Account

3.3 Free trial

The yearly plan of Niairo Plus may come with a 7-day free trial. Apple decides whether you are eligible, and this is shown on the purchase screen
Unless cancelled at least 24 hours before the trial ends, the yearly price is charged when the trial ends, and the subscription then renews automatically
During the free trial, you can use up to 20 Checks in total

3.4 Number of Checks

The daily limit of Niairo Plus (10 Checks) resets at midnight Japan time
Checking the same image again, or a Check that could not be completed, does not count
Limits exist to keep the service stable and to prevent misuse. If we change them, we will announce it in the App in advance

4.Conditions of use

4.1 Who can use the App

The App is intended for people aged 13 and over
If you are a minor, please get your parent or guardian's consent before using the App or buying Paid Features

4.2 Images used for Checks

Please use images you may use for a Check, such as photos you took yourself or screenshots you saved for your own viewing
Before sending an image, the App detects and blurs faces on your device. However, side profiles or small faces may not always be blurred. When people are in a picture, please crop to just the clothing
We ask for your consent to send images the first time you use a Check

4.3 Prohibited conduct

You must not:

Break the law or act against public order and morals
Use images that infringe others' rights (such as portrait rights, privacy or copyright)
Send images unrelated to clothing or cosmetics for purposes other than a Check
Increase the number of Checks or use Paid Features by improper means
Place excessive load on the App or the Check server, or use them in bulk by automated means
Reverse engineer, decompile or disassemble the App
Copy, modify or distribute the App
Do anything else the Developer considers inappropriate

5.Intellectual property

Intellectual property rights in the App and its content (text, Diagnosis questions, Reports, illustrations, logos, icons, etc.) belong to the Developer or their respective owners
You may use result cards you save for personal use and for sharing on social media and the like

6.Disclaimers

6.1 Provision of the service

The App is provided as is. We do not guarantee fitness for a particular purpose, completeness or accuracy
Checks may be unavailable due to network conditions or outages of external AI services

6.2 Damages

The Developer compensates you for damage caused to you for reasons attributable to the Developer
However, where the Developer is not acting willfully or with gross negligence (i.e. slight negligence), compensation is limited to direct and ordinary damage, up to the amount you paid for Paid Features in the 12 months before the damage occurred (or ¥1,000 if you paid nothing)

6.3 Data

Your Diagnosis results, Check history, settings and so on are stored on your device. If data is lost through device failure, loss, deleting the App or similar, the Developer cannot restore it
Purchased Paid Features can be re-enabled with “Restore Purchases”

6.4 Changes, suspension and termination

We may change the App's contents to improve its features
We may suspend the App or Checks for maintenance or to fix problems
We may end the App. If so, we will announce it in the App in advance where possible

7.Privacy

Information is handled according to our separate Privacy Policy.

8.External services

Checks use an AI service of Anthropic, PBC to read Attributes. Purchases and payments for Paid Features are handled by Apple. The terms set by each of these companies may apply to their services.

9.Distribution through the App Store

If you obtained the App from Apple's App Store, Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies in addition to these Terms. Where these Terms and Apple's standard EULA differ, Apple's standard EULA prevails for matters relating to distribution through the App Store.

10.Governing law and jurisdiction

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction in the first instance over any dispute relating to these Terms.

11.Changes to these Terms

We may change these Terms when needed. If we do, we will announce the new content and its effective date on this page and in the App. If you use the App on or after the effective date, you agree to the changed Terms.

13.Severability
